Step 1: obtain an affidavit
An affidavit is an efficient, effective way to document the authority of a trustee. This Affidavit of Authority, an original death certificate, and the Trust will be required by all entities whom the trustee will interact with. This might include banks, insurance companies, and others. Affidavits must be notarized and filed or recorded in the county records. They must contain:
- name of the Trust
- date the Trust was signed
- date of the grantor’s death
- name of the trustee
