Service Partner Network Pre-Screening Disclosure
SERVICE PROFESSIONAL PRESCREENING PROCEDURES AND DISCLAIMERS. MyEstateManager.com uses the following criteria as part of its registration enrollment process ("registration") for new service professionals, with the exception of Corporate Accounts (as described below) and service professionals providing services in Canada (which are not screened) applying for membership in our network:
- County Criminal Check – We check for felony convictions, alcohol violations, revocation of driving privileges, and misdemeanors. To pass the check, there may be no felony convictions, no more than one alcohol violations (DUI/DWI, public nuisance, drunk in public) within 5 years, no revocation of driving privileges within 24 months, and no misdemeanors (except minor traffic) within last 36 months.
- National Criminal Check – We check for criminal charges, Sex Offenders, FBI, Terrorist Watch, DOJ, ATF and others. To pass there must be no negative/derogatory/non-valid status that results in a HIT confirmed with county criminal check.
- Social Security Trace – We verify social security numbers. To pass, the appropriate name and number must match.
- State License – We confirm Network Partners have active state licenses and check for derogatory information. To pass, the appropriate license must be valid and in good standing.
- County Civil – We check for suits naming the company. To pass, there must be no pending lawsuits directly relating to the nature of the service to be provided.
- Corporate Charter – We check the Secretary of State records to confirm business filings. To pass, the appropriate charter/articles must be in good standing.
- Reverse Phone Lookup – We perform a reverse phone lookup on Internet or confirm entity number by dialing directly. To pass, the listed phone number must be confirmed.
- Internet Search – Review entity Web site or locate business through Internet Search. To pass, the partner’s internet contact information must be confirmed.
- Performance History – We review the Better Business Bureau report and perform review of complaints filed with State Consumer Affairs Office. To pass, the Partner must have no significant pattern of consumer complaints.
- NIPR (Insurance Industry) – We check insurance producers, agents and brokers for derogatory items, violations, license suspensions or disciplinary actions. To pass, there must be no significant pattern of negative derogatory information.
- FINRA (Financial Industry) – We check for financial fraud, derogatory complaints, including SEC violations, disciplinary actions reported to licensing agencies. To pass, there must be no significant pattern of negative derogatory information.
- FACIS 3 (Healthcare Industry) – We check for Medicare fraud, derogatory complaints, and disciplinary actions. To pass, there must be no significant pattern of negative derogatory information.
- Commercial or Professional Insurance – We verify coverage of commercial or professional liability coverage. To pass, required insurance policy coverage must be confirmed.
- Crime Bond – We verify crime bond coverage for appropriate entity types. To pass, entities required to have crime bonds must have such bond status confirmed as in good standing.
- Code of Ethics – We do not limit our requirements to background checks alone. Providing families with trusted service partners requires that businesses and individuals who work directly or indirectly with families maintain a high standard of ethics. With that in mind, all MyEstateManager.com organizations, employees and volunteers agree to abide by our MyEstateManager Code of Ethics.
- Be Trustworthy: Subscribe to sound business practices that exhibit honorable values and provide families with clear and confident expectations.
- Adhere to Highest Professional Standards: Maintain professional integrity and competence at all times, never knowingly causing harm, fraud, or abuse.
- Uphold Responsibilities: Fulfill all contractual agreements with families in a timely and professional manner.
- Respect Others: Treat family with patience, dignity and respect.
- Comply with all Licensing and Regulatory Requirements: Observe all licensing and regulatory requirements for each state and jurisdiction served.
NOTE: Network Partner information confirmed at the time of their enrollment as described above may change or expire over time; while MyEstateManager.com attempts to maintain accurate and up-to-date information, and confirms changes when notified, we perform screening solely at the time the member applies for membership in the MyEstateManager.com network, and therefore, we cannot guarantee that profile and screening information is accurate. Therefore, we recommend that before working with a service professional you verify that information presented in the service professional's profile is still current and/or acceptable to you.
Corporate Accounts - Some Network Partners are employees, franchisees, dealers, or independent contractors ("Corporate SP's") of larger national or corporate accounts ("Corporate Accounts"). In such event, you may be matched with the Corporate Account entity or with one of their Corporate SP's.
Service Partner Network Profiles: MyEstateManager.com allows Service Partners to post profiles about themselves and their business on the MyEstateManager Digital Business Card. MyEstateManager.com does not review or verify the information or representations set forth in those profiles, except as expressly set forth above, as they are self-reported by the Service Partners.
The above procedures may change from time to time at the sole discretion of MyEstateManager.com. MyEstateManager.com believes that it uses commercially reasonable methods to check these matters but does not make any representations or warranties that members are appropriately licensed, free of significant state-level civil legal judgments, or carry appropriate general liability insurance or bonding at the time of registration, during the period they are members, or thereafter. As circumstances can change daily, MyEstateManager.com advises consumers to check these matters for themselves especially at future dates. MyEstateManager.com does not represent or warrant that the information received from state, provincial or other government agencies or from third party sources is accurate, error free, or that it is up to date or updated at the time that MyEstateManager.com checks such information. Most agencies have periodic update cycles or schedules and this information is not updated on a real-time basis by such agencies and third party sources.
